    - Access to downloadable resources (e.g., home buyer/seller guides, property reports, educational content, etc..)

    We work with both individual clients and sponsored real estate professionals.

    3. USER RESPONSIBILITIES

    You agree to use our services lawfully and responsibly. You must not:

    - Submit false, misleading, or unauthorized information

    - Impersonate another person or use fake contact details

    - Attempt to gain unauthorized access to our systems or accounts

    - Use our platform for spam, unsolicited contact, or fraudulent activity

    Sponsored real estate agents with portal access are responsible for maintaining the confidentiality of their login credentials.

    4. DATA COLLECTION & USE

    We collect and use client and agent data to deliver and improve our services. This includes:

  • Data Collected:
    - Name & spouse’s name (if applicable)

  • - Phone number(s)

  • - Email(s)

  • - Property address(es) & estimated home value

  • - Ideal home buying budget & preferences

  • - Responses to buyer/seller intake questions

  • - Real estate agent work history, business goals, and contact details

  • How Data Is Used:

    - Educate buyers and sellers on the real estate process

    - Provide property updates, evaluations, and appointment reminders

    - Deliver marketing and/or promotional offers

    - Send educational content and brokerage announcements

    Your information may be processed using secure third-party platforms, including our CRM system (FLY Steep, LLC), Meta Ads (formally Facebook), Instagram, Google, etc.


  • 5. TEXT MESSAGING & A2P 10DLC COMPLIANCE

    By providing your mobile number and opting in through our website, forms, or other methods, you consent to receive

    automated SMS messages from us for both marketing and transactional purposes, such as:

    - Property updates, showings, & appointments

    - Competitive Market Analysis reminders and updates

    - Educational content and brokerage training

    - Marketing and/or Promotional offers

    - General client and sponsored agent communication


    Compliance Details:

    - We only send texts with express written consent

    - All opt-in forms link to our Privacy Policy (www.EliteRealEstateTexas.com/privacy-policy)

    - You can opt out at any time by replying "STOP" or "OUT"

    - We track and honor all opt-out requests in accordance with A2P 10DLC industry regulations

    Message and data rates may apply based on your mobile carrier plan.

    Affiliate/Referral Disclosure:
    Sometimes we earn referral fees or pay referral commissions when we connect clients with preferred partners or other licensed real estate agents. These are disclosed at the time of transaction in accordance with applicable laws.


    7. COOKIES, ANALYTICS & TRACKING

    We use cookies and tracking technologies (e.g., Google Analytics, Facebook Pixel, other third-party retargeting services) to improve your experience and track marketing performance.

    There is no general refund policy. Any refunds or cancellations must comply with the contractual terms of the transaction in question.


    10. DISPUTE RESOLUTION

    Any disputes arising from the use of our services or site shall be resolved first through mediation, and if unresolved, through binding arbitration in Tarrant County, Texas. Any disputes arising must comply with the contractual terms of the transaction in question.

    By using our services, you waive your right to participate in class-action lawsuits or jury trials related to these Terms.
